1. Acceptance of Terms

By downloading, installing, or using EQ Trainer ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and EQ Trainer ("we," "our," or "us"). We reserve the right to modify these Terms at any time. Continued use of the App following any changes constitutes your acceptance of the new Terms.

2. Description of Service

EQ Trainer is an AI-powered emotional intelligence training application that provides:

  • Simulated conversation scenarios for communication practice.
  • AI-generated dialogue responses, feedback, and expert demonstrations.
  • Voice input and text-to-speech functionality.
  • Training progress tracking and analytics.
  • Role-switching and strategy breakdown exercises.

The App is a training tool designed for educational purposes. It is not a substitute for professional counseling, therapy, or mental health services.

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have parental or guardian consent to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. Account and Authentication

  • The App uses Apple Sign In for authentication. You are responsible for maintaining the security of your Apple ID.
  • You are responsible for all activity that occurs under your account.
  • You must not share your account credentials or allow others to access your account.
  • You must notify us immediately if you suspect unauthorized use of your account.

5. Subscriptions and Payments

5.1 Subscription Plans

The App may offer subscription plans that provide access to premium features. Subscription details, including pricing and features, are displayed within the App and on the App Store.

5.2 Billing

  • All subscriptions are billed through Apple's App Store and managed by Apple's StoreKit framework.
  • Payment will be charged to your Apple ID account upon confirmation of purchase.
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your Apple ID account settings.
  • Cancellation takes effect at the end of the current billing period.
  • Refund requests must be directed to Apple, as all payments are processed through the App Store. Visit reportaproblem.apple.com.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful, harmful, or fraudulent purpose.
  • Attempt to manipulate, exploit, or abuse the AI system to generate harmful, offensive, discriminatory, or illegal content.
  • Input personally identifiable information of third parties without their consent during training conversations.
  • Use the App to harass, threaten, or intimidate any person.
  • Attempt to reverse-engineer, decompile, or disassemble the App or its AI systems.
  • Interfere with or disrupt the App's servers, networks, or infrastructure.
  • Use automated tools, bots, or scripts to access or interact with the App.
  • Reproduce, distribute, or commercially exploit any content generated by the App without our written permission.

7. AI-Generated Content

7.1 Nature of AI Content

The App uses artificial intelligence to generate dialogue responses, feedback, expert demonstrations, and strategic analysis. You acknowledge that:

  • AI-generated content is created for training and educational purposes only.
  • AI responses may not always be accurate, appropriate, or representative of real-world situations.
  • The App does not provide professional advice (legal, medical, psychological, financial, or otherwise).
  • AI characters and scenarios are fictional simulations, not real people or events.

7.2 No Guarantee

We do not guarantee that using the App will result in improved communication skills, better relationships, or any specific outcome. The App is a practice tool, and results depend on your individual effort and circumstances.

8. Intellectual Property

  • The App, including its design, features, code, AI models, scenarios, and content, is owned by us and protected by intellectual property laws.
  • You retain ownership of the text you input during training sessions.
  • We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
  • You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI-GENERATED CONTENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to use the App.
  • Any conduct or content of any third party on the App.
  • Any AI-generated content obtained from the App.
  • Unauthorized access, use, or alteration of your transmissions or content.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless EQ Trainer and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Termination

  • We may suspend or terminate your access to the App at any time, with or without cause, with or without notice.
  • You may stop using the App at any time by deleting it from your device and canceling any active subscriptions.
  • Upon termination, your license to use the App will immediately cease.
  • Sections relating to Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification shall survive termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with applicable rules.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EQ Trainer regarding your use of the App and supersede all prior agreements and understandings.
